At the request of Elie Beatty this Deed was recorded August 26, 1833.
This Indenture made and concluded this twenty ninth day of April in the year of our Lord one thousand eight hundred and thirty three between Elizabeth Friend, Preston Friend, Eleanor Friend, Henry Friend, George Faulkwell and Rebecca Faulkwell of Washington County in the State of Maryland of the one part and Elie Beatty of said State and County of the other part; Witnesseth that whereas it has been heretofore agreed by the said Elizabeth, Preston, Eleanor, Henry, George and Rebecca together with Nancy Friend the wife of the said Henry, and Abraham Newson and Lucinda, his wife, of Marion County in the State of Ohio to sell and convey to the Elie Beatty the real estate of the late Jacob Friend of Washington County aforesaid, situate in said County at the Confluence of the Conococheague Creek with the Potomac River for the price and at the rate of fifty five dollars per acre, except one acre and a half heretofore sold to William Price and Arthur Johnston; Now this Indenture Witnesseth that for and in consideration of the sum of fifty five dollars per acre by the said Elie Beatty, before the sealing and delivery of these presents in hand paid to the said Elizabeth, Preston, Eleanor, Henry, George, Rebecca, Abraham and Lucinda, the said Elizabeth Friend, Preston Friend, Eleanor Friend, Henry Friend, Nancy Friend, George Faulkwell and Rebecca Faulkwell have given, granted, bargained and sols and by these presents do give, grant, bargain and sell unto the said Elie Beatty all their estate, right, title, claim and demand of each, all and every of them in and unto all the real estate situate in Washing County aforesaid whereof Jacob Friend, late of said County died seized or possessed or in any way entitled to including part of a tract of land called “Swedes Delight” part of a tract of land called “Reserve No.4, part of a tract of land called “White Oak Swamp”, part of a tract of land called “Trifle” and part of a tract of land called “None Left”, Beginning to include the said recited parts of tracts of land, and the end of twenty two and three quarter perches revered in the Sixth line of None Left and running with said line reversed, North fourteen degrees, West twenty tow and a quarter perches, north thirty eight degrees, West fifty seven perches, then South forty five and a half degrees, West four and a half perches to the end of the tenth line of Trifle, then with line of said land reversed, North forty four degrees, West twenty perches, North thirty nine degrees, West twenty four perches, then North sixty two and three quarter degrees, West seventy seven perches to the end of the sixth line of the land belonging to Jacob Jones, then with said line reversed , North twenty five degrees, East seventy two perches to a stone standing on the tenth line of “Swedes Delight” then with that line by an allowance of one degree to correct the variation of the compass, South forty seven degrees, East seventy four perches, then leaving said line, North fifty degrees, East one hundred and eight perches and three fourth of a perch to the North side of the road leading (Text inserted over the scanned copy – I can’t read what is written) road South forty two and three quarters degrees, East nineteen perches, South three fourths of a degree, East sixty six perches, South thirty six degrees, East twenty five and three quarter perches, South forty three degrees East fifty perches, South thirty and three quarters degree, East sixty nine and three quarters perches, South fifty nine degrees, East three perches to the lower corner of the east abutment of the old bridge on the edge of the Conococheague Creek, then down said Creek with the several meanders thereof, South twenty four degrees West twenty one and three quarters perches, South twenty nine and three quarters degrees West eight perches, South forty seven and a half degrees, West then perches, South sixty three and a half degrees, West eight perches, South eighty one degrees, West eight perches, North eighty five degrees, West eleven perches, North seventy seven and a quarter degrees, West thirty two perches, South eighty six degrees, West twenty perches, South sixty eight degrees, West seven and three quarter perches to the South side of the Canal where a stake is set up as the beginning of the lot of ground containing one acre and a half conveyed to William Price and Arthur Johnston, then with the given line of said part and with the condemnation for the use of the Chesapeake and Ohio Canal Company, North thirty one and a half degrees, West twenty two and three quarter, [sic] then by a straight line to the beginning, containing and now laid out for one hundred and eight one acres and twenty perches of land to be the same more or less, together with all their and each of their right, title, interest, claim and demand to every part or parcel of land, contained within the said metes and bounds by whatsoever name the same may have conveyed or held and also of, in or unto any and all land lying contiguous or adjacent thereto or in Washington county aforesaid together with all and singular the rights, privileges and appurtenances thereunto, in any wise belonging or appertaining; To have and to hold the said land and premises and every part and parcel thereof with the appurtenances as unto him the said Elie Beatty, his heirs and assigns forever, to the only proper use, benefit and behoof of him the said Elie Beatty, his heirs and assigns and to and for no other use, intent or purpose whatsoever; In testimony whereof they the said Elizabeth, Preston, Eleanor, Henry, George, Rebecca and Mary have hereunto set their hands and seals the day and year first above within written.
